You must read, agree with and accept all of the terms and conditions contained in this User Agreement and the Privacy Policy, which include those terms and conditions expressly set out below, before you may become a member of Ontario Flea Markets .

By accepting this User Agreement, you also agree that your use of other Ontario Flea Markets websites will be governed by the User Agreement and Privacy Policy posted on this website. We do not control the information provided by other users which is made available through the Site. You may find other user's information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and practice safe trading when using the Site. Please note that there are also risks of dealing with foreign nationals, underage persons or people acting under false pretence. By using this Site, you agree to accept such risks and Ontario Flea Markets is not responsible for the acts or omissions of its users.

We may amend this Agreement at any time by posting the amended terms on the Site. All amended terms shall automatically be effective immediately after they are initially posted on the Site. If you do not agree to changes in the User Agreement or Privacy Policy User Agreement, then you must stop using the Service. If you do not stop using the Service, then your use of the Service will continue under the changed User Agreement and Privacy Policy User Agreement.

CONDITIONS OF USE

You are entirely responsible and liable for all postings to Ontario Flea Market. Listed below are some, though not all, violations which may result in Ontario Flea Market deleting your postings. You agree not to do any of the following requests while posting an ad to Ontario Flea Market.

* harass, threaten, embarrass or slander any person or entity;
* transmit via Ontario Flea Market any information, data, text, files, links, software, chat, communication or other materials ("Content") that Ontario Flea Market considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, racially, ethnic ally or otherwise objectionable;
* impersonate in Ontario Flea Market any business or person, living or dead, famous or not;
* intentionally or unintentionally violate any applicable local, state, national or international law, including but not limited to any regulations having the force of law while using or accessing Ontario Flea Market or in connection with your use of Ontario Flea Market in any manner.

INTELLECTUAL PROPERTY

You agree that you will not upload or transmit any Content to Ontario Flea Market that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party. By submitting Content to Ontario Flea Market you automatically grant -- or warrant that the owner of such Content has expressly granted -- Ontario Flea Market the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed for the full term of any Rights that may exist in such Content.

CONTENT

You must evaluate, and bear the risk associated with, the accuracy, completeness or usefulness of any Content. Ontario Flea Market shall not be responsible for any Content. Ontario Flea Market does not prescreen or monitor all Content as a matter of policy, but Ontario Flea Market shall have the right, but not the responsibility, to remove Content which is deemed in sole discretion harmful, offensive, or otherwise in violation of this Agreement or any rules Ontario Flea Market has in place at the time. Ontario Flea Market may elect at its sole discretion to monitor some, all, or no areas of Ontario Flea Market for adherence to this Agreement or rules.

DISCLAIMER OF WARRANTIES

You expressly agree that use of Ontario Flea Market is at your own risk. Ontario Flea Market shall not be responsible to you for any content found on Ontario Flea Market . Ontario Flea Market expressly disclaims all warranties of any kind, whether implied warranties of merchant ability, fitness for a particular purpose, and non infringement. Ontario Flea Market makes no warranty that Ontario Flea Market will be timely, secure, error free, or meet your requirements; nor does Ontario Flea Market make any warranty as to the results that may be obtained from the use of Ontario Flea Market or as to the accuracy or reliability of any information obtained through Ontario Flea Market. No advice or information, whether oral or written obtained by you from Ontario Flea Market shall create a warranty not expressly made herein. You understand and agree that any content down loaded or otherwise obtained through the use of Ontario Flea Market is done at your own discretion and risk and that you will be solely responsible for any damages to your computer or loss of data that results in the down loads of such content. To the full extent permissible under the applicable law, Ontario Flea Market shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use or inability to use Ontario Flea Market or for the cost of procurement of substitute goods and services resulting from any goods or services purchased or obtained through your use of the Ontario Flea Market classified ads system.

This Agreement is effective upon acceptance in registration for new registering users, and is otherwise effective on Feb. 08, 2009 for all users.
